CONFIDENTIALITY NOTICE: NY VICTIMS OF DOMESTIC VIOLENCE

NOTICE CONCERNING NEW YORK DOMESTIC VIOLENCE VICTIMS

New York Insurance Law § 2612 provides certain protections to victims of domestic violence.

An insured victim of domestic violence may present to InsurancesHQ at its home office a valid order of protection issued by a New York court against any insured under a policy in which the victim is also an insured. In such a situation, and while that order of protection remains effective, InsurancesHQ must first obtain the victim’s express consent before disclosing the victim’s address and telephone number (or the address and telephone number of a child residing with the victim) to the person against whom the victim has obtained the order of protection. In addition, InsurancesHQ may not disclose information about any person or entity providing covered services to the victim. If a child is covered by such an order of protection, this right may be asserted by, and also includes, the parent or guardian of the child.

In addition, the New York Insurance Law provides that the fact that a person is or has been a victim of domestic violence is not permitted as an underwriting criterion. The New York Insurance Law prohibits insurers from taking the following actions solely because a person is or has been a victim of domestic violence:
